Things You Should Know About Chapter 7 Bankruptcy Houston Texas

1.  You must provide a list of all your creditors and if you miss a creditor it may not be discharge.  Well this is only if you have an asset case and a claims docket is open.  Thus the creditor never has a opportunity to collect in the bankruptcy. If you have a no asset case, the creditor gets zero and thus is still discharged.

2.  In Houston Texas you can claim either federal or state exemptions.  Exempt property is property you get to keep.  Non-exempt property is sold to pay your bills.  Once upon a time, your body was non-exempt. These days are gone and public policy in Texas is generous for those in debt.

3.  Current monthly income id defined as the average income over the six months previous to the commencement of the bankruptcy case. This includes spousal income if filing jointly.  It does not include social security.

4.  The creditor has 30 days to object to your claim of exemptions in a chapter 7 from the date of the 1st 341 meeting of creditors. The 1st meeting of creditors must be held within 45 days of file date of the petition.

5.  The creditors have 60 days to object to the discharge from the 1st meeting of creditors.
