Divorce Appeals Texas

Divorce in Houston

If you feel that that were errors in the presentation of the trial and you are not satisfied with the outcome the trial in the  final divorce, you have the right to appeal the judge’s decision based on what you think is an erroneous decision or mistakes made on the part of the deciding party. In Texas, winning your case in a court of appeals does not necessarily mean the outcome of your trial will be modified, but you may get a chance to bring your case to trial again.  You must act quickly.  Most of your trial attorney do not handle appeals. As a result, they will not talk activity with you about the deadlines.  I have a deadline calculator here

Process

The Divorce Appeals Texas process can be a long and complicated process because the difficult to prove that the judge made an error during the first trial is on the contesting party. Appeals in Texas must be filed within 30 days of the final divorce decree and in a specific format outlining the appellant’s view of the case and why a mistake was made. Your finding of facts and conclusions of law must be filed within 20 days of the judgment.  If you file a motion for new trial, you can extend out the courts power and your dead line to appeal 90 days from the judgment having been signed.  The appeals court is not interested in the facts of your divorce case, only in the court proceedings that may warrant a new trial or a new decision in your divorce. Although sometimes the court is so one-sided, they may exam your facts for the rationale for the decision.
