  3. Debtor’s Responsibility: The burden falls on the debtor to dispute and resolve the issue, even though they no longer owe the debt.

Why You Need to Check Your Credit Report Post-Bankruptcy

After receiving a bankruptcy discharge, it’s essential to ensure that all debts included in the filing are correctly reported on your credit report. A proper report should show:

  • Zero Balance ($0.00): The debt balance must be listed as zero.
  • Status: The status should read “Included in Bankruptcy.”

If these details are incorrect, you may be at risk of zombie debt reappearing.


How to Dispute Errors on Your Credit Report

Disputing inaccurate credit reporting is straightforward but requires diligence. Follow these steps:

  1. Access Your Credit Reports:
    • Visit www.annualcreditreport.com to access your free credit reports from the three major bureaus: Equifax, Experian, and TransUnion.
  2. Identify Errors:
    • Review each report for debts that should be marked as discharged but are not.
  3. File a Dispute:
    • Select the debt in question and click on Dispute through the credit bureau’s online platform.
    • Choose the reason for the dispute (e.g., “Included in Bankruptcy”).
  4. Wait for Resolution:
    • The bureau must investigate the dispute within 30 days. If the debt was indeed discharged, the report should be corrected.

  • Can Be Resold: Debt buyers may purchase and attempt to collect on it, thinking it’s valid.

  • Places the Burden on You: Even though the debt is no longer valid, you are responsible for disputing it.

As highlighted in a recent credit.com article, new legislation aims to protect consumers from zombie debts by:

  • Improving Reporting Accuracy: Requiring creditors to correctly update credit reports after a bankruptcy discharge.
  • Introducing Penalties: Holding creditors accountable for failing to report discharged debts accurately.

While these measures are promising, they emphasize the importance of proactive credit monitoring.


Check Your Credit Report After Discharge
